The agreement

These terms are an agreement between you and Jason Luo (“we”), who run Biro. By creating an account or using Biro you accept them. Our Privacy policy explains what happens to your information.

Who may use Biro

You must be at least 13 years old. If you are under 18, you may use Biro only with the permission of a parent or guardian, who accepts these terms for you and is responsible for your use. Schools and other organisations that give Biro to students must have any consent their rules or law require.

Your account

Give a real email address, keep your password to yourself, and tell us if you think someone else has used your account. You are responsible for what happens in your account. One account is for one person.

Acceptable use

Use Biro to learn and to make things. Do not:

• break the law, or help anyone else to;
• upload material you have no right to share, or that invades someone’s privacy;
• harass, threaten or harm anyone, or create sexual content involving minors;
• try to get around plan limits, security or rate limits, or share an account to do so;
• scrape, copy or resell Biro or its answers in bulk, or use them to build a competing service;
• disrupt Biro, probe it for weaknesses without our permission, or overload it.

We may limit, suspend or close an account that breaks these rules.

Your content

What you put into Biro, such as questions, drawings, PDFs and pictures, stays yours. You give us permission to process it only to run Biro for you, including sending it to the services named in the Privacy policy. You may use the answers Biro gives you for your own learning and work. Other people may get similar answers to similar questions.

AI answers can be wrong

Biro’s answers, drawings and spoken explanations are made by AI. They can be wrong, incomplete or out of date, even when they sound sure. Check anything that matters. Biro is not a substitute for a teacher, doctor, lawyer, financial adviser or any other professional, and nothing in it is professional advice. Follow your school’s rules about using AI in your work.

Biro in ChatGPT

These terms also apply when you ask Biro to draw an answer from inside ChatGPT, where OpenAI’s terms for your ChatGPT account apply as well. You must be 13 or older. A board drawn this way is kept behind a link that anyone who has it can open, so do not put personal details in a question. Biro draws a limited number of boards for each person in ChatGPT each day and says so when the limit is reached.

Plans and payment

• Free: a daily allowance of typed answers, shown by the meter in Biro, without cloud voice.
• Pro: $12 a month, when paid plans open: unlimited typed answers within fair use, and voice. Fair use means what one person asking for themselves would use. We may slow or pause an account whose use looks automated or shared, and Biro will say so when it does; a pause ends the next day.

Paid plans are not open yet. When they open, the price, billing period, renewal, cancellation and refund terms will be shown before you pay, and you will not be charged without agreeing to them. We may change plans and prices, with notice before a change affects what you pay.

If you connect your ChatGPT plan in Settings, your typed answers are written on that plan and count toward its limits, and OpenAI’s terms for your ChatGPT account also apply to them. You can disconnect at any time in Settings.

Ending your account

You can delete your account at any time from Your data. We may suspend or close an account that breaks these terms, or stop offering Biro, and will give notice where we reasonably can. The parts of these terms that by their nature should last, such as the limits below, continue after an account ends.

Changes to Biro and these terms

Biro is new and will change: features may be added, changed or removed. When these terms change we will update the date at the top, and for a change that matters we will tell you in Biro or by email before it takes effect. Using Biro after that means you accept the new terms.

Limits on our responsibility

Biro is provided “as is” and “as available”, without warranties of any kind, as far as the law allows. We do not promise it will be uninterrupted, error free, or that it will keep your data on your device safe from loss: keep your own backups. As far as the law allows, we are not liable for indirect or consequential losses, lost data or lost profits, and our total liability to you is limited to the greater of what you paid us in the 12 months before the claim and 50 US dollars. Nothing here limits rights you have that the law does not allow to be limited.

Your responsibility for misuse

As far as the law allows, if someone makes a claim against us because of content you uploaded or because you broke these terms, you will cover our reasonable costs of dealing with it.

Copyright complaints

If you believe something in Biro infringes your copyright, write to jluo6200@gmail.com with: the work you own, where it appears in Biro, your contact details, a statement that you believe in good faith the use is not authorised, a statement that your notice is accurate and that you are the owner or allowed to act for them, and your physical or electronic signature. We will remove material that infringes, and close the accounts of people who infringe repeatedly. If your material was removed and you believe that was a mistake, you can write to the same address to ask for it to be restored.

Governing law and disputes

These terms are governed by the law of the State of Ohio, USA, except where the law where you live gives you the right to rely on its own rules and courts. If you have a problem with Biro, please write to us first; most things can be sorted out that way. If we cannot resolve it within 30 days, either of us may take it to the state or federal courts located in Ohio, or to a small claims court where you live if it qualifies.

General

These terms and the Privacy policy are the whole agreement between you and us about Biro. If a court finds part of them cannot be enforced, the rest still applies. If we do not enforce a part straight away, we have not given up the right to enforce it later. You may not transfer these terms to anyone else; we may transfer them to someone who takes over running Biro, and will tell you if we do. If you send us ideas or feedback, we may use them without owing you anything.
